The Guide to the Safeway BOGO Class Action Settlement

The Safeway BOGO Class Action Settlement stems from the lawsuit Stewart et al. v. Albertsons Companies, Inc., where plaintiffs alleged that Safeway, Inc. (“Safeway”) and its parent company, Albertsons Companies, LLC (“Albertson’s”), overcharged consumers on certain meat products subject to “Buy One, Get One Free” (BOGO) promotions by charging inflated prices, higher than the original or non-promotional price. Although the companies deny these allegations, the Circuit Court of the State of Oregon for the County of Multnomah has approved the settlement of these claims in a class action.

As a result, all qualified class members may obtain a substantial payment (approximately $200), without taking on any further burden of litigation. All claims and settlements are being paid out and administered, on behalf of the class members, by Postlethwaite & Netterville, an experienced claims administration firm overseen by the Court and counsel.

This page contains step-by-step instructions to ensure that parties who are qualified may file a claim pursuant to a final decision in order to receive their portion of the settlement without undue burden.

How do I File I Claim?

If you purchased eligible meat products at Safeway stores in the United States that were offered as part of a BOGO or Buy One Get Two Free promotion, you are a member of the settlement class. Specifically, you are a class member if:

  • You purchased meat products at Safeway stores located in Oregon between May 4, 2015 and September 7, 2016;
  • You purchased meat products using a Safeway Club Card;
  • You purchased meat products offered as part of a “Buy One Get One Free” or “Buy One Get Two Free” promotion.

Class members who received a notice by mail or email were determined to be automatically eligible to receive payment and did not have to file a claim in order to be paid. If you did not receive such a notice but believe you meet the eligibility requirements, you were required to submit a claim by June 16, 2023. No payment or fee is required in order to participate in the settlement.

Filing a Claim in Nine Easy Steps

Submitting a claim for your settlement payment is an easy process that is only handled by the Claims Administrator, Postlethwaite & Netterville. To ensure that your claim gets submitted and processed properly, follow these steps:

  • Check Eligibility: Verify your purchase history and eligibility to ensure you can submit a claim based on the requirements listed above.
  • Documents Necessary: While not always required, if you purchased between February 29, 2012 and September 7, 2017, having a receipt, relevant Safeway Club Card number(s), or transaction records can help if the Claims Administrator requests it to verify your claim.
  • Find the Official Claim Form Website: The only website authorized to accept claims for the settlement is at https://safewaybogoclassaction.com/. Do not submit to any third-party or “shadow” websites.
  • Fill Out the Claim Form: Enter your full name, current mailing address, email address, phone number, and other requested information. Accurately provide your Safeway Club Card number(s) and describe any qualifying purchases if known.
  • Submit Your Claim: Claims can be submitted online through the official website or via a paper form sent directly to the Claims Administrator at 789 N Cascade Ave Ste 58, Colorado Springs CO 80903.
  • Keep Confirmation: After submission, keep a copy of any submission you make as well as any confirmation receipt or code provided by the Claims Administrator so you can track your claim status.
  • Know That There is a Deadline: The deadline for claim submission was June 16, 2023. Claims submitted after this date will not be honored.

If you already received a notice or have filed your claim, no action is needed by you.

What Happens Next?

After receiving your claim form, the Claims Administrator determines whether your claim is complete and satisfies the requirements for approval. If your claim is approved, a settlement payment (estimated to be about $200) is then issued to you. Here’s what happens after you submit your claim:

  • Review of your claim: The Claims Administrator reviews your information against Safeway’s records for verification and may seek additional documentation if required.
  • Notification of approval: A confirmation will be sent to you via mail or email, based on your communication preference.
  • Distribution of payment: The Claims Administrator began distributing settlement payments on September 25, 2023. Payments are typically made by check mailed to your address or, if you selected during claims submission, by digital payment (direct deposit or PayPal).
  • Address change/Payment change: Notify the Claims Administrator immediately about any changes to your contact information or if you would like to use a different payment method.

The Claims Administrator handling the Safeway BOGO Class Action Settlement is officially tasked with answering all questions related to this settlement.

Opt Outs, Objections, and Deadlines

Class members who did not wish to participate in the settlement or who objected to the settlement terms were given an opportunity to do so before the Court’s final approval. The deadline to opt out or object was July 25, 2023. All requests received after the deadline were not considered. If you were not eligible to opt out or object by July 25, 2023, you are automatically a part of the settlement and are entitled to benefit from it as outlined. You need take no further action unless you need to update your address or have not received your check.
